NJAC 15:22 Library Network Services and NJAC 15:21, State Library Aid and Grants have been readopted as of November 12, 2010 and will be published in the December 20, 2010 Register. No substantive changes were made to Network, and the substantive changes for PCSA are (1) the requirement for paid print periodical titles was removed because of the availability of electronic resources and (2) an increase in the amount of library-related education for library trustees from three hours per year per board to seven hours per year per board. We received one comment for Network and one for State Aid. Neither comment was unsupportive of the changes.

By the way, the rules did not expire in June as we follow a process that gives us another 180 days to readopt a regulation. \x93Under the provisions of Executive Order No. 66 (1978) and N.J.S.A. 52:14B-5.1, N.J.A.C.15:22, Library Network Services, will expire on June 15, 2010. In accordance with N.J.S.A. 52:14B-5 .1c, as this notice of proposal was submitted to the Office of Administrative Law prior to the expiration date, that date was extended 180 days to December 12, 2010.\x94

For practical purposes, please maintain your minimum amount of paid print periodicals through December 31, 2010. You may cancel subscriptions, if you wish, as of January 1, 2011. Note that libraries are still required to have access to back issues with indexes and that this requirement is met by the electronic resources provided by the State Library.

For the 2011 data year, trustees will be required to have 7 hours per year per board of training. What is appropriate library-related training is at the discretion of the library director and board president as they sign the "Accuracy Certification" for the annual survey/PCSA application. Examples of library-related education include continuing education dealing directly with library issues or broader topics such as customer service. The training requirement may be met by workshops provided by the State Library and LibraryLinkNJ, webinar training and in-house training. Watching a video/DVD on serving the elderly and having a library in-service day (you may want to join with other libraries if you decide this might be valuable) would all qualify. It is anticipated that there are many free opportunities for CE such as the Trustee Workshop generally held in September. In the past, this workshop has been free to one trustee from each library.

Regarding the Network regulation, obviously there have been big changes since we started the review process in July of 2009. Because the process of readoption takes over a year and one must start all over again if any substantive changes are to be made, it was decided that it would be better to move forward with what we had rather than to let the Network regulations expire. As NJSL and LibraryLinkNJ gain experience with the new configuration, we will review the regulations and propose amendments as needed. NJAC 15:22, Library Network Services, will sunset June 15, 2010 unless re-adopted. Since the regulations were substantially re-worked in 2005, NJSL proposes that these rules be re-adopted with minor changes. Following are the proposed changes.

Recommended changes:

  1. Need to correct spelling in N.J.A.C. 15:22-1.8. [Exectuive] Executive board: organization and duties

  2. Need to change: N.J.A.C. 15:22-1.10 (b) 3 regarding five-year plan to three-year plan to be consistent with rest of document.

  3. Need to remove: (e) under N.J.A.C. 15:22-1.17, Allocation of library network funds

(e) No less than 40 percent of the funds made available for the regional library cooperative shall be allocated in the annual operating budget of a regional library cooperative, and expended as necessary, to reimburse regional contract libraries for services to residents of the library region.

Reasoning: this section no longer pertains to the actual use of network funds.
