The FCC has released some clarifications and answers to frequently asked questions regarding the new rules they codified in the Sixth Report and order. I have attached both of these documents to this message. There is one very important clarification to know about. In the document named \x93DA-10-2356_Sixth Report and Order Clarification_12-15-2010.doc\x94 on page 4 there is a question regarding CIPA and E-rate. The answer that the FCC provides brings the rules back to what they used to be before the Sixth Report and Order was issued regarding CIPA. In short, a library would not need to filter if they are only applying for E-rate discounts on a transport circuit and not on the internet access through that circuit. This is particularly important for JerseyConnect customers who apply for E-rate on their transport circuits but get their internet access for free.
According to the FCC the new Forms 470 and 471 will be available for use on or before the date that the filing window opens (January 11, 2011). The New Jersey State Library has put out an RFP for high speed access to connect libraries to the JerseyConnect network. That RFP will be the basis of a blanket Form 470 that libraries can use, if they are seeking discounts on this type of service, to cite on their Form 471s. Under this scenario libraries would not file their own Form 470s, they would just have to file their Form 471 and cite the State Library\x92s Form 470. The New Jersey State Library is in consultation with a nationally renowned E-rate consultant to work out the exact steps that we need to take for this process to result in successful E-rate applications for participating libraries.
We will have more guidance for you as the date of the new forms\x92 availability approaches. For now please hold off on submitting any Forms 470 (especially if you are a library participating in the broadband upgrade portion of the BTOP program) until we send out more information about the shape the application process will take.
