Hi, all.

 

Please note that financial disclosure form information for joint, municipal and county libraries will soon be distributed by the municipality/county and that all forms will be submitted online this year. Trustees and directors are required to submit these forms annually (NJSA 40A: 9-22.1 et seq.).

 

Financial Disclosure Forms - 2013

The Division of Local Government Services is developing an online process for Local Government Officers (LGOs) to file their financial disclosure statement forms commencing in 2013. Specific information will be provided in a Local Finance Notice at a later date. It is anticipated that the online form process will "go live" no later than the end of March 2013. Therefore, the Local Finance Board "temporarily" will not be enforcing the provision of N.J.S.A. 40A:9-22.6(b) requiring newly elected/appointed LGOs to file their financial disclosure statements within 30 days of taking office. Instead, newly elected/appointed LGOs who commence their office on and after January 1, 2013, but before the April 30, 2013 deadline, will be required to file their financial disclosure statements using the online process. This will ensure that the financial disclosure statements of all LGOs will be uniformly filed online in 2013.

Determining Local Government Officers Required to File

Local government officers are required to file an FDS. N.J.S.A. 40A: 9-22.3g defines a local government officer as:

... any person, whether compensated or not, whether part-time or full- time:

(1) elected to any office of a local government agency;

(2) serving on a local government agency, which has the authority to enact ordinances, approve development applications or grant zoning variances;

(3) who is a member of an independent municipal, county or regional authority; or

(4) who is a managerial executive or confidential employee of a local government agency, as defined in Section 3 of the "New Jersey Employer-Employee Relations Act," P.L. 1941,c.100(C.34: 13A-3), but shall not mean any employee of a school district or member of a school board.
